Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Whhe ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access or use the App.

You must be at least 18 years old to use this App. By using Whhe, you represent and warrant that you are of legal age to form a binding contract.

2. Description of Service

Whhe provides baby care tracking services including but not limited to:

• Activity tracking (feeding, sleep, diapers, medications, etc.)
• Growth and milestone monitoring with WHO percentile calculations
• AI-powered insights and recommendations
• Family sharing and collaboration features
• Data storage, synchronization, and export capabilities
• Appointment scheduling and reminders
• Photo storage for milestones and activities
• Subscription-based premium features

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice to users. Critical service changes will be communicated via email or in-app notifications.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information when creating an account
• You must notify us immediately of any unauthorized use of your account
• You may not use another person's account without permission

4. Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose or in violation of these Terms
• Upload false, misleading, or harmful content
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's operation
• Reverse engineer, decompile, or disassemble the App
• Use the App to harm minors in any way
• Collect or store personal data about other users without consent
• Use the App for commercial purposes without our written permission

5. Intellectual Property

The App and its original content, features, and functionality are owned by Whhe, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you upload to the App. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely for the purpose of providing the service.

6. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

You are responsible for maintaining appropriate security and privacy settings for your baby's information.

7. Disclaimers

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The results obtained from the App will be accurate or reliable
• Any errors in the App will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Whhe SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

Our total liability to you for any damages shall not exceed the amount you have paid to us in the past twelve months, or $100, whichever is greater.

9. Subscription Terms

Premium Features: Certain features of Whhe require a paid subscription. Subscription fees are charged in advance on a recurring basis.

• Billing: Subscriptions are billed through your app store (Apple App Store or Google Play Store)
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
• Price Changes: We may change subscription prices with 30 days notice
• Refunds: Refunds are subject to app store policies and applicable law
• Free Trial: Free trials automatically convert to paid subscriptions unless cancelled

10. Indemnification

You agree to indemnify and hold harmless Whhe, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of or related to your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the App will immediately cease. You may delete your account at any time through the app settings, which will immediately and permanently delete all your data.

Subscription Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. Canceling your subscription does not delete your account or data - your data remains accessible even with a canceled subscription. To permanently delete your data, you must explicitly delete your account. No refunds will be provided for partial periods unless required by law.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms in the App and updating the "Last Updated" date.

Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Israel, without regard to conflict of law provisions.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
